BYE MILLS FARM TERMS AND CONDITIONS OF HIRE
Should there be anything you feel we should be made aware of in order to ensure your comfort and safety whilst you are with us, please do not hesitate to inform us.
THE HIRING CONTRACT SHALL BE BETWEEN THE HIRER AND THE OWNER OF THE PROPERTY.
THESE CONDITIONS MUST BE STRICTLY ADHERED TO.
BOOKING
Guests must be over 21 years of age at the start of their stay
The property specifies the maximum number of guests allowed and must be strictly adhered to.
The name of each occupant must be listed on the booking form.
Any alteration to this booking form must be with the consent the owner. The signatory must be a member of the party and signs to accept full responsibility on behalf of all the members of the party in meeting the terms and conditions of the rental.
The right to occupy the property may be forfeited without compensation or may be subject to additional charges if more guests than specified on the booking form, or that the property holds, take up occupation.
We reserve the right to refuse a booking if it is deemed not to be in either the guests or in our best interests.
Our property is let on the basis that the accommodation is for holiday use only and that no rights to remain in the accommodation exist for the guest or anyone in the party.
The property provides bed linen and towels, please refer to property description for anything else.
MAKINGYOUR BOOKING
To book the Property with us you should make the payment specified in the initial quote we email to you (the “Quote”). If the Quote stipulates that you pay an initial deposit (the “Initial Deposit”) followed by a balance payment (the “Balance”), you must make both payments within the time periods specified. If the Quote asks you to make a payment in full, you must pay the full amount by the due date. If the Quote specifies that any damage deposit (the “Damage Deposit”) and/or a cleaning or other fee(s) (“Other Fee(s)”) is payable, you must also make that/those payment(s) within the time period specified.
Once the Initial Deposit or full payment has been received, you will receive an email confirming the Booking. The contract between us will only be formed when you receive the payment confirmation email and is subject to these Booking Conditions.
You should carefully check the details of your Booking before making a payment, as well as the confirmation email and inform us immediately of any errors or omissions.
PAYING FOR YOUR BOOKING
Where you have only paid an Initial Deposit, you are required to send to us your payment for the Balance and the Damage Deposit and/or Other Fee(s) within a certain period prior to the arrival date specified in your Quote (the “Arrival Date”). If you fail to make a payment due to us in full and on time we may treat your Booking as cancelled by you.
The Damage Deposit may be used for any repair and/or replacement of the Property, furnishings, fixtures and fittings that are necessary after your stay. We will return the Damage Deposit to you following the return of the keys to us, less any deductions in accordance with the conditions listed above. Any Cleaning Fee will be used to clean the Property, furnishings, fixtures and fittings
following your stay and is non-refundable. Any Other Fee(s) will be described in the Quote and are non-refundable.
CANCELLATION
If you need to cancel or amend your Booking you must write to us or email us as soon as possible. A cancellation will not take effect until we receive confirmation in writing or via email from you. The cancellation policy described in your Quote (“Cancellation Policy”) applies to your booking.
IF WE CANCEL OR AMMEND YOUR BOOKING
We would not expect to have to make any changes to your booking, but sometimes problems occur and we do have to make alterations or, very occasionally cancel bookings.
If this does happen, we will contact you as soon as is reasonably practical and inform you of the cancellation or the change to your Booking. If we cancel your Booking, we will refund you any fees you have already paid to us. However, we will not be liable to refund you for any fees you may have paid to any third party in connection with your holiday (including, without limitation, fees for travel, entertainment, activities or insurance).
INSURANCE
WE STRONGLY RECOMMEND THAT YOU TAKE OUT SUITABLE CANCELLATION INSURANCE.
Your insurance should cover all risks including cancellation, accident, breakdown, loss or damage to personal property.
The owner shall not be held responsible or liable for any loss or damage suffered by the guest or members of the party.
NON AVAILABILITY OF PROPERTY
If for any reason, the property is not available or has become unsuitable for the date booked, we will make every reasonable effort to arrange suitable alternative accommodation.
If this is not possible or acceptable to the guests, all rental monies paid in advance will be refunded in full and the guest will have no further claim against the owner or the agent.
DESCRIPTION OF PROPERTY/AMENDMENTS
Whilst every effort has been made to describe as fully as possible the property, we cannot accept responsibility or liability for any changes or for any disappointment caused where a guest has differing expectations to those detailed in the description.
All details are given in good faith and are believed to be correct at the time they were printed but their accuracy cannot be fully guaranteed.
Any amendments will be fully available on our web site.
Every effort will be made to ensure the standard of the property is maintained and that all items of equipment described and supplied by the owner are in good working order.
However, no guarantee is given or liability accepted if any breakdown occurs. Repairs are always effected as soon as possible, although inevitably delays do occur.
OCCUPYING THE PROPERTY
Guests may occupy the property between 4pm – 9pm on the start date of their holiday and must vacate the property by 10.00pm on their leaving date.
Arrivals outside these hours are only permitted by prior arrangement and every effort will be made to ensure the keys are made available.
However early entry cannot be guaranteed.
Guests must keep the owner fully informed of any changes.
The guests must keep the property and all furniture, fixtures, fittings and effects in or on the property in the same state of repair as at the start of the rental period and should leave the property clean and tidy ensuring all furniture that has been moved is re-positioned.
Please note that the convention for UK holiday cottage differs from hotels and other countries in that guests are expected to leave the property in a similar state to which they find it (reasonable cleaning excepted). Please abide by this convention so we can continue to offer good value.
Guests must ensure that the owner’s request for the property to be smoke free and areas to be pet free is adhered to.
Any breach of these conditions may incur extra cleaning costs.
Guests must not do anything to make void or voidable any policy of insurance and must not cause a nuisance to neighbours.
The general rules applying to the property must be adhered to and the guest must allow the owner, owner’s representative or the agent reasonable access.
If, in the opinion of the Owner, any person is not suitable to continue their occupation of the property because of unreasonable behaviour, damage or nuisance to other parties, the contract may be treated by the owner as discharged and the owner may repossess the property immediately. The guest will remain liable for the whole cost of rental and no refund shall be due.
The guest must agree to take all necessary steps to safeguard their personal property.
HOT TUB
Bathers must not wear lotions, oils, makeup or skin creams in the spa pool.
Shower with soap and water before and after using the hot tub. Showering before use washes away many of the common skin bacteria and removes lotions, deodorants, creams etc. which reduce the effectiveness of the spa sanitizer which disinfects the water.
Please ensure feet are clean before entering the hot tub, please use z flip flops or your own footwear to walk to the hot tub.
In the event a daily test results in a negative result the hot tub may need to be closed until such time the hot tub is safe for use.
Bathers must not use the spa pool if they have had diarrhoea within the last 14 days.
No incontinent person may use the spa pool, either with or without a waterproof nappy.
Bathers are discouraged from swallowing the spa pool water.
Water temperatures are set to 37°C, this may be set higher in the colder months.
At 39-40°C limit your time in the hot tub to a maximum of 20 minutes as extending this time can affect your inner organs and cause fever like conditions. At 36-37°C this time can be extended as this is body temperature.
Take care when entering and leaving the hot tub. When leaving the hot tub leg muscles may be relaxed enough to make you unsteady.
Glassware must not be used in or around the hot tub.
Take care on the patio/hot tub steps as water from the tub and from rain can cause it to be slippery.
Please be considerate to neighbours when using the hot tub.
Parents are advised that the hot tubs are not suitable for children under the age of sixteen.
It is recommended that the spa pool is not used after a heavy meal or while under the influence of alcohol or sedatives.
Intended users suffering from diseases of the heart and circulation, skin conditions, are immuno-suppressed, subject to fits, or taking drugs affecting the cardiovascular or nervous systems, should not use spa pools without first seeking medical advice.
Pregnant women are advised to consult with their doctor before using a spa pool.
Never use the hot tub while using or after using narcotics or other drugs that may cause sleepiness, drowsiness or raise/lower blood pressure.
If any allergic reaction occurs leave the hot tub and rinse off in the shower. If the reaction persists go to a local doctor or A&E.
Avoid entering the hot tub water immediately after exercising as the water temperature can affect the heart rate.
COMPLAINTS
All complaints must be reported to the owner as soon as possible during occupation to enable the owner or appointed agent the opportunity to carry out an investigation and effect remedial action. If the owner is denied the opportunity of investigating the complaint or denied the opportunity of rectifying the problem, whilst the guest was in the property or had returned home, the guest will have waived all rights to any further investigation or any compensation that may have been applicable.
COMPLAINTS PROCEDURE
Please check the apartment on arrival if you feel that the property is not to your standard you must call the owner and ask them to clean it to the point where you are satisfied. No compensation will be given on grounds of cleanliness if the cleaner has not been contacted.
Please contact the Owner as soon as possible so that action may be taken.
Complaints may be submitted in writing to the Owner within 6 days of your stay.
PETS
Pets are not permitted
SMOKING
Our property is a no smoking property.
Guests are responsible for upholding this condition and act responsibly with regard to keeping outside areas clean and tidy.
PERSONAL PROPERTY
If items are left behind the guest should advise us as soon as possible to enable a search to be made. (It may not be possible to locate the item if the property has been re-let until after the new guests depart).
Re-imbursement for postage, packing, plus any other expenses incurred will be required before the item can be returned.
Items which are not claimed for or where postage re-imbursement fees have not been received, will be kept for 21 days only before being disposed of.
PRICE CHANGES
Where an error or omission has occurred, we reserves the right to amend prices.
MATTERS BEYOND OWNER/AGENT’S CONTROL
The owner cannot accept liability for work taking place outside the boundary of the property or for any noise or nuisance arising, over which the owner or agent has no control.
If the owner is made aware of any major works in the immediate vicinity of the holiday property, before the guest arrives, which, in our opinion, may severely affect the enjoyment of the guest’s holiday, this will be treated as’ non-availability of the property’ and this clause shall then apply.
COMMUNICATING WITH YOU
The guest acknowledges that the owner will take personal information such as the guests name, contact information etc... This will be used to process the booking.
The Owner will not pass these details on to third parties other than in relation to bookings – owners employees (such as the cleaner / caretaker).
With your consent we will use your data in relation to marketing by the owner and their data management – companies/individuals employed by the agent to undertake on the agents behalf such tasks as sending brochures, managing/analysing data.
BREACHES TO THE CONDITIONS OF HIRE
The owner reserves the right to terminate the holiday booking for any serious breaches of these conditions of hire.
OUR LIABILITY
Our maximum liability for losses you suffer as a result of us acting in breach of these terms and conditions is strictly limited to the total fees you have paid for the Booking.
We shall not be liable for any losses which are not a foreseeable consequence of us breaking these Booking Conditions. Losses are foreseeable where they could be contemplated by you and us at the time your Booking is confirmed by us.
Your Booking is made as a consumer for the purpose of a holiday and you acknowledge that we will not be liable for any business losses howsoever suffered or incurred by you.
We shall not be liable to you for any personal injury or damage to or loss of personal property, except where the injury, damage or loss is caused by our negligence.
This does not exclude or limit in any way our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude or limit, or attempt to exclude or limit, our liability.
LEGALITY OF CONDITIONS
Any dispute will be governed by the non-exclusive law and jurisdiction of the English courts.
In the event a court finds that a condition in the Conditions of Hire is illegal or void, the illegal or void condition will be severed from the remainder of the conditions of hire, which will continue to be valid and have full force and effect.
